Can immigrants and green card holders get Obamacare?
Lawfully present immigrants can buy Marketplace coverage and can qualify for the premium tax credit. Here is who counts and how mixed status families apply.
- Lawfully present immigrants can buy Marketplace coverage and can qualify for the same premium help as citizens.
- People without lawful immigration status cannot buy Marketplace coverage or get premium tax credits.
- Families apply together and only the eligible members enroll, even in a mixed status home.
Yes, if you are lawfully present in the United States. You can buy a plan on the Marketplace, the government site for shopping health plans. You can also get the premium tax credit, help that lowers your monthly bill. The rules for that help are the same as they are for citizens.
A lot of bad information goes around about this question.
Who counts as lawfully present
The list is wider than most people think. It includes:
- Lawful permanent residents, meaning green card holders.
- People with valid non immigrant visas, including work and student visas.
- Refugees and people granted asylum.
- People with Temporary Protected Status.
- People granted withholding of removal.
- People with certain applications pending, including asylum applicants with work authorization.
- Certain survivors of trafficking and domestic violence.
If you are not sure which one fits you, bring your papers in and we can look. Guessing makes people skip coverage they had a right to.
Who cannot enroll
People without lawful immigration status cannot buy Marketplace coverage or get premium tax credits. That is federal law and no agent can change it.
Some care is still open to them. Medicaid is the state health plan for people with low income.
- Emergency Medicaid for emergency conditions, including labor and delivery, no matter your status.
- Federally qualified health centers and community clinics, where the fee is based on what you earn.
- Hospital charity care and bill help, which every non profit hospital must give.
- Direct pay, where you pay the clinic yourself for the visit.
Mixed status families
Families get this part wrong more than any other, and it costs them coverage.
A family can apply together and only the eligible members enroll. Children who are citizens or lawfully present can get Medicaid or Marketplace coverage. They can also get CHIP, the same kind of plan for kids. That holds even if a parent is not eligible. Applying for your child does not create a problem for you.
What you put on a Marketplace application is used to decide who qualifies for coverage. The application asks about status only for the people applying. Family members who are not applying still count for household size and income. They are not asked about their status.
The five year rule, and where it does not apply
Many lawfully present immigrants face a five year wait for full Medicaid. Marketplace coverage has no such wait. You can enroll and get help with the premium right away.
There is a second rule for lawfully present people who earn too little for the usual help. If you are in the five year Medicaid wait, you may still qualify for Marketplace help. For some families that is a real way out of the Texas coverage gap. People in the gap do not qualify for Marketplace help or for Texas Medicaid. See the coverage gap.

Common follow-up questions
Will applying affect my immigration case?
Marketplace coverage and premium tax credits are not counted in the public charge test. We are insurance agents, not immigration lawyers. Ask an immigration attorney about your own case.
Can I apply for my children if I am not eligible myself?
Yes. Families apply together and only the eligible members enroll. This is common. It is how the form is built to work.
Do I have to wait five years like Medicaid?
No. The five year bar applies to full Medicaid. It does not apply to Marketplace coverage or to the premium tax credit.
